Hoom Health Terms and Conditions

Effective date: When these Terms are first published in the Service
1. Who We Are
These Terms and Conditions (the Terms) govern access to and use of Hoom Health, including its websites, applications, APIs, health archive, artificial intelligence features, sharing functions, and related services (collectively, the Service).
The Service is provided by the person or legal entity identified as the Hoom Health operator in the legal and contact information displayed in the Service (Hoom, we, us, or our). That information will include the operator's legal name, business address, and registration details where applicable.
Contact information:
- General and support requests may be submitted through the support or contact method displayed in the Service.
- Privacy and data-protection requests may be submitted through the privacy controls or contact method displayed in the Service.
- Legal notices may be sent using the operator's legal contact details displayed in the Service.
- If a Data Protection Officer is appointed, their contact details will be identified in the Privacy Notice.
Our Privacy Notice, made available in the Service, explains how we collect, use, share, retain, protect, and delete personal data. It forms part of the legal information governing the Service but does not replace any consent that the law requires us to obtain separately.
2. Acceptance and Eligibility
By creating an account, purchasing a subscription, or using the Service, you agree to these Terms. If you do not agree, do not create an account or use the Service.
You must be at least 18 years old and legally capable of entering into a contract. The current Service and its AI Health Review are intended only for adults. They are not designed for paediatric, pregnancy, fertility, or prenatal assessment.
You may enter or upload information about another person only when you are legally authorised to do so, such as when you have that person's valid consent or lawful authority to act as their caregiver or representative. You must not create a profile for another person merely because you know or care for them.
If you use the Service on behalf of an organisation, you represent that you are authorised to bind that organisation. Additional business terms may apply.
3. What the Service Does
Hoom is a patient-controlled health archive and information-organising service. Depending on the available features and your plan, the Service may allow you to:
- Upload and store medical records and other files.
- Enter notes, symptoms, medications, readings, and other health information.
- Extract structured information from documents and notes.
- Search and visualise health information over time.
- Generate AI-assisted summaries and health reviews.
- Identify possible health considerations, trends, missing information, questions, or tests to discuss with a qualified clinician.
- Share selected portal information with people you authorise.
- Download or export information made available through the Service.
Some features may be labelled beta, experimental, preview, or similar. Such features may be incomplete, inaccurate, changed, suspended, or withdrawn.
4. Hoom Is Not Medical Care
Hoom does not replace a doctor, pharmacist, emergency service, laboratory, or other qualified healthcare professional. Unless we expressly state otherwise in a separate written agreement, Hoom does not provide medical care, a final diagnosis, a prescription, treatment, emergency monitoring, or a clinician-patient relationship.
AI-generated summaries, reviews, possible conditions, risk observations, suggested questions, and suggested tests are informational aids. They may be incorrect, incomplete, outdated, misleading, or inappropriate for your circumstances. They must be reviewed against the original source and discussed with a qualified healthcare professional.
Do not start, stop, or change medication or treatment based only on the Service. Do not delay professional care because of information produced by the Service.
No Emergency Use
The Service is not an emergency or continuous-monitoring system. It may not detect urgent or life-threatening conditions and is not designed to contact emergency services. If you believe you may have a medical emergency, contact your local emergency service immediately. Do not wait for Hoom or rely on Hoom to evaluate the situation.
5. Accounts and Security
You must provide accurate, current information and keep it updated. Each account is personal unless we explicitly support another account type.
You are responsible for:
- Protecting your password, authentication tokens, devices, and email account.
- Using a unique password and reasonable device security.
- Logging out of devices you do not control.
- Notifying us promptly through the support or security contact method shown in the Service if you suspect unauthorised access, token theft, or another security incident.
- Activities performed through your account until you notify us, except where applicable law provides otherwise.
You must not share login credentials. Use the Service's sharing controls when you want another person to access your portal.
We may temporarily lock an account after repeated failed authentication attempts or when reasonably necessary to protect users, Hoom, or the Service.
6. User Content and Ownership
User Content includes every file, document, image, note, reading, symptom, medication record, comment, correction, profile field, message, and other item that you or an authorised user submits to the Service.
As between you and Hoom, you retain the rights you have in your User Content. You grant Hoom a limited, non-exclusive, worldwide licence to host, copy, transmit, format, parse, transform, index, display, and otherwise process User Content only as necessary to:
- Provide and secure the Service.
- Perform operations you request.
- Maintain backups and resilience.
- Comply with law and enforce these Terms.
- Carry out separately consented model-improvement activities described in Section 9.
This licence ends when the relevant content is deleted, subject to reasonable backup cycles, legal retention requirements, information retained to establish or defend legal claims, and the separate rules for properly anonymised data.
You represent that you have the rights and authority required to submit User Content and allow the processing described in these Terms and the Privacy Notice.
7. Health-Data Processing and Explicit Consent
Health records and facts inferred from them may constitute sensitive or special-category personal data. Before Hoom processes health data, we will ask you to provide explicit consent through a separate, clearly labelled action. Accepting these Terms alone is not that explicit consent.
When you provide the required Core Health Data Consent, you explicitly consent to Hoom processing the health information you submit and health information derived from it for the following specified purposes:
- Creating and maintaining your private health archive.
- Storing original records and manually entered information.
- Extracting, structuring, normalising, indexing, and searching health facts.
- Displaying readings, symptoms, medication periods, documents, notes, and timelines.
- Generating summaries or reviews when you request an AI feature.
- Enabling access by users to whom you grant read or write permission.
- Protecting the Service, preventing abuse, recovering data, and investigating security incidents.
You may withdraw consent using the privacy or consent controls in the Service, or by contacting Hoom through the privacy contact method displayed in the Service. Withdrawal does not invalidate processing lawfully performed before withdrawal. Because processing health data is essential to the health archive, withdrawing the Core Health Data Consent may require us to disable relevant features or close and delete the account, subject to legal retention requirements.
Our Privacy Notice provides the controller identity, data categories, purposes, legal bases, recipients, international transfers, retention periods, rights, complaint process, and other legally required information.
8. AI Processing and External Model Providers
Hoom may use artificial intelligence, machine-learning, document-processing, OCR, embedding, and large language model providers (AI Providers) to provide features you request.
When you invoke an AI feature, you instruct Hoom to send the content reasonably necessary for that operation to the AI Provider selected by Hoom. Depending on the feature, that content may include medical documents, extracted text, readings, symptoms, medications, notes, existing summaries, source identifiers, and related metadata.
Hoom may select, replace, or use multiple AI Providers based on quality, availability, security, privacy, location, performance, and cost. The current AI Providers, their processing locations, transfer safeguards, and material retention terms will be identified in the current Privacy Notice or subprocessor information made available through the Service. We will provide notice of material changes where required by law.
We will require AI Providers that process personal data on our behalf to process it under appropriate contractual and security obligations. Hoom will not authorise an external AI Provider to use identifiable User Content to train that provider's general-purpose models unless:
- We clearly disclose the provider and the proposed use;
- The use is lawful and covered by appropriate contracts and safeguards; and
- You provide a separate explicit opt-in consent for that specific use.
AI output is probabilistic. Validation mechanisms reduce but cannot eliminate fabrication, extraction errors, mistranslation, omission, incorrect units, incorrect dates, duplicate facts, or unsupported medical reasoning. You should review AI-generated information and correct errors through the available tools.
9. Optional Consent for Hoom Model Improvement and Training
Improving or training Hoom's algorithms is not necessary to provide your core health archive. Hoom will therefore request a separate, optional, explicit Model Improvement Consent. Refusing or withdrawing this consent will not prevent you from using the core Service or change the price or basic quality of your plan.
If you separately opt in, you explicitly consent to Hoom processing the following categories of information for developing, training, fine-tuning, testing, validating, evaluating, monitoring, and improving Hoom-owned or Hoom-commissioned algorithms, prompts, extraction tools, safety systems, and AI features:
- Original medical documents and other files you upload.
- Notes and manually entered information.
- Readings, symptoms, medications, timelines, and other structured health facts.
- Information inferred or extracted from User Content.
- AI prompts, AI responses, summaries, and health reviews.
- Corrections, ratings, feedback, and other quality signals.
- Relevant technical and usage metadata needed to evaluate system performance.
Hoom may combine this information with information from other users who have also opted in. Hoom will apply data minimisation and, where compatible with the purpose, remove direct identifiers, pseudonymise data, or use aggregated or anonymised forms. Access will be limited to authorised personnel, contractors, and processors with confidentiality and data-protection obligations.
This consent does not permit Hoom to:
- Sell identifiable health data.
- provide identifiable health data to advertisers, employers, insurers, data brokers, or unrelated third parties;
- Use the data to determine eligibility for employment, insurance, credit, or another unrelated service; or
- Allow an external model provider to train its general-purpose model unless the additional requirements in Section 8 are satisfied.
You may withdraw Model Improvement Consent at any time through the privacy or consent controls in the Service, or by contacting Hoom through the privacy contact method displayed in the Service. After valid withdrawal, Hoom will stop adding your personal data to new training or evaluation datasets and stop future consent-based processing, subject to the time reasonably necessary to propagate the request and any processing or retention independently required by law.
Withdrawal does not retroactively invalidate processing performed while consent was valid. Information that has been irreversibly anonymised so that it is no longer personal data may continue to be used. Hoom will assess trained artifacts and other retained outputs under applicable data-protection law and will take the deletion, restriction, retraining, or other measures that the law requires.
10. Sharing and Delegated Access
You control whether another registered user receives read or write access to your portal. Before granting access, verify the recipient carefully. Read access may expose sensitive health information. Write access may allow the recipient to add or modify information and, where the plan permits, request AI processing using the portal owner's quota.
You may revoke access through the sharing controls. Revocation prevents future access through Hoom but cannot recall information that a recipient lawfully downloaded, copied, printed, or recorded while access was active.
A shared user must use access only for the purpose authorised by the portal owner and must not disclose, misuse, alter, or download information without authority. Shared users are responsible for actions taken through their accounts.
Hoom may record sharing changes and access events for security, support, compliance, and audit purposes.
11. Accuracy, Sources, and Corrections
User Content, extracted facts, and AI interpretations can contain errors. Hoom may show source links to help distinguish original material from extracted or generated information, but a source link does not prove that an extraction or interpretation is correct.
You are responsible for reviewing information before relying on, sharing, or presenting it to a healthcare professional. Use the correction and editing features when information is wrong. Editing a structured fact may not update the original document, and editing an original note or document may not automatically regenerate every derived fact.
Hoom may mark content as processing, processed, failed, or requiring review. These statuses describe system workflow and are not clinical validation.
12. Acceptable Use
You must not:
- Use the Service for an emergency or as a substitute for professional care.
- Represent AI output as a confirmed diagnosis or professional medical advice.
- Upload content you are not authorised to process.
- Access or attempt to access another person's portal without permission.
- Share credentials or bypass authentication, quotas, security, or access controls.
- Introduce malware, scrape the Service, probe vulnerabilities without written authorisation, or disrupt the Service.
- Use the Service to discriminate or make employment, insurance, credit, or similar high-impact decisions about another person.
- Resell access, operate an unauthorised service bureau, or commercialise health information obtained through Hoom.
- Use the Service unlawfully, fraudulently, deceptively, or in a way that violates another person's rights.
We may investigate suspected misuse and restrict or terminate access where reasonably necessary.
13. Plans, Usage Limits, and Billing
Available plans, prices, currencies, billing intervals, taxes, and independent usage limits are displayed before purchase. AI-related allowances may be separate for documents, notes, summaries, reviews, or other operations. Reaching one allowance may block that operation while leaving other available allowances usable.
A free allowance, if offered, may be available only once per user. Upgrades may take effect after payment confirmation. Downgrades and cancellations may take effect at the end of the current paid billing period. Expired paid accounts may be moved to a read-only plan instead of receiving another free allowance.
Payments may be processed by a payment service provider or merchant of record. Its checkout, payment, tax, refund, and buyer terms may also apply. Payment providers receive billing and transaction information; Hoom does not intend to send medical documents or health facts to them.
Subscriptions renew automatically at the interval shown at checkout until cancelled. Before purchase, we will display the total price, applicable tax, renewal frequency, plan limits, and cancellation method. You authorise the payment provider to charge the selected payment method for each renewal.
You may cancel future renewal through the billing controls in the Service or through the payment provider's customer portal. Unless law or the Refund Policy requires otherwise, cancellation stops future charges and paid access continues until the end of the current period.
Refunds are governed by the Refund Policy made available in the Service, the payment provider's rules, and mandatory consumer law. Nothing in these Terms removes a statutory right of withdrawal, remedy, refund, or cancellation. Where applicable law permits immediate performance to affect a withdrawal right, we will request the required express request and acknowledgement separately at checkout.
We may change future prices or plan limits by providing advance notice required by law. Price changes do not apply retroactively to a completed billing period. If you do not accept a change, you may cancel before it takes effect.
14. Failed and Duplicate Processing
AI and document-processing operations can fail. Failed assets may remain visible with a failed status and reason. When our published plan rules provide for a quota refund after an internal or provider failure, the refund affects only the usage counter and does not necessarily delete the failed asset.
Hoom may avoid regenerating a summary or review when no new source data is available. A deduplicated or cached result should not consume an additional allowance where the applicable plan states that it will not.
15. Hoom Intellectual Property
Except for User Content, Hoom and its licensors own the Service, software, design, branding, prompts, schemas, models, documentation, and other materials made available through the Service.
Subject to these Terms and your plan, Hoom grants you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose. This licence does not permit copying, reverse engineering, reselling, sublicensing, or creating a competing service from protected Hoom materials, except where applicable law does not allow such a restriction.
Feedback is voluntary. You grant Hoom permission to use feedback without payment or attribution, provided that doing so does not grant Hoom broader rights to your health data than Sections 7 through 9 permit.
16. Privacy, Security, Retention, and Deletion
We use technical and organisational measures intended to protect personal data, including access controls and encryption where described in the Privacy Notice. No system is completely secure, and we cannot guarantee that unauthorised access, loss, or disruption will never occur.
We retain personal data only for the periods or criteria described in the Privacy Notice. You may request access, correction, export, restriction, objection, consent withdrawal, or deletion where applicable by using the privacy controls in the Service or the privacy contact method displayed there.
Deleting an account or item may not immediately remove every copy from backups. Limited information may be retained where necessary for security, fraud prevention, payment and tax records, legal compliance, disputes, or legal claims. Properly anonymised information may be retained because it no longer identifies a person.
17. Third-Party Services
The Service may rely on or link to hosting, AI, email, payment, analytics, authentication, storage, or other third-party services. Their availability and separate terms may affect functionality. A link does not mean Hoom endorses all content or practices of the third party.
Hoom remains responsible for its own legal obligations and does not use this section to exclude responsibility that applicable law assigns to Hoom.
18. Availability and Changes to the Service
We aim to provide a reliable Service but do not guarantee uninterrupted or error-free availability. Maintenance, security incidents, provider outages, capacity limits, legal requirements, or technical failures may interrupt access.
We may add, change, suspend, or discontinue features. Where a change materially reduces a paid Service, we will provide notice or a remedy where required by law. We will provide reasonable export or transition options when legally and technically appropriate.
19. Suspension and Termination
You may stop using the Service and request account deletion at any time. Subscription cancellation and account deletion are separate actions unless the interface expressly states otherwise.
We may suspend or terminate access when reasonably necessary because of:
- A material or repeated breach of these Terms.
- Fraud, abuse, unauthorised access, or a security threat.
- Non-payment or a reversed or disputed payment.
- A legal, regulatory, court, or payment-provider requirement.
- A risk of harm to a user, another person, Hoom, or the Service.
Where appropriate and lawful, we will provide notice and an opportunity to remedy the issue. Sections intended by their nature to survive termination, including ownership, accrued payment obligations, lawful retention, disclaimers, and dispute terms, will survive.
20. Disclaimers
To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis. We do not promise that:
- The Service or AI output will be medically, factually, or technically complete or accurate.
- Every document or language will be parsed correctly.
- Every relevant condition, risk, interaction, trend, or abnormal result will be identified.
- A clinician will accept or rely on information produced by Hoom.
- The Service will meet every regulatory, clinical, insurance, or recordkeeping requirement applicable to you.
Mandatory consumer guarantees and rights remain unaffected.
21. Limitation of Liability
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud, wilful misconduct, gross negligence, death or personal injury where exclusion is prohibited, breach of mandatory consumer rights, or violation of data-protection obligations to the extent the law prevents limitation.
Subject to the previous paragraph and to the maximum extent permitted by law, Hoom is not liable for indirect, incidental, special, consequential, or punitive loss, or for loss of profit, opportunity, goodwill, or data, arising from use of or inability to use the Service.
This section does not reduce remedies available under mandatory digital-service, consumer, medical-device, product-liability, or data-protection law.
22. Governing Law and Disputes
These Terms are governed by the laws applicable to the Hoom operator identified in the Service, without depriving a consumer of mandatory protections available in the country where the consumer habitually resides.
Before starting formal proceedings, contact Hoom through the support or legal contact method displayed in the Service so we can attempt to resolve the issue. Consumers may also use courts, regulators, alternative dispute mechanisms, or complaint procedures available under mandatory local law. Nothing in these Terms requires a consumer to use an exclusive forum where that requirement would be unlawful or unfair.
Privacy complaints may be submitted to the competent data-protection authority, including the authority in the user's place of residence, work, or alleged infringement where applicable.
23. Changes to These Terms
We may update these Terms for legal, security, technical, operational, or product reasons. We will identify the latest revision date and provide advance notice of material changes where required by law.
A material change will not retroactively expand an existing health-data or model-training consent. If a new purpose requires consent, we will request a new consent before starting that processing. If you do not accept revised Terms, you may stop using the Service and cancel the subscription before the change takes effect.
24. General Terms
If a provision is held invalid or unenforceable, the remainder remains effective to the extent legally possible. Failure to enforce a provision is not a waiver.
You may not transfer your account or these Terms without our consent. Hoom may transfer these Terms as part of an incorporation, financing, reorganisation, merger, acquisition, or sale of assets, subject to applicable notice, data-protection, and consumer-law requirements. Such a transfer does not permit the new operator to use health data for incompatible purposes without a valid legal basis and, where required, new consent.
These Terms, the Privacy Notice, the plan and checkout disclosures, and any policies expressly incorporated into them form the agreement concerning the Service. Mandatory law prevails where these documents conflict with it.
